There’s big business in the production of fake IDs. However, there are also hefty consequences for using one. The penalties for using a fake ID in Pennsylvania can be severe. Getting caught using a false or altered ID can result in fines, jail time, or a misdemeanor on your permanent record. So what happens if you get caught with a fake id?

What’s Considered Use of a Fake ID?

Having a fake ID is often considered a right of passage or a “victimless crime” and, as such, isn’t given a lot of credit by those committing the crime. It may seem like a harmless act but can create a lot of trouble when something comes up.

Using a fake ID can include something as simple as using an older sibling’s ID to get into the bar while visiting friends at college. More often, fake IDs are used to buy and transport alcohol or tobacco products to those unable to purchase on their own. One of the worst ways to use a fake ID is to present it to a law enforcement officer.

Using Fake ID for Alcohol or Tobacco Products

The legal age of consumption and possession for alcohol and tobacco is 21. If you are trying to bypass this age requirement with (or without) a fake ID, you can expect steep fines and parental notification.

The minimum fine for the purchase and consumption of alcohol and tobacco by a minor is $500. Then it’s $1000 for each subsequent incident. These charges are increased if you’re suspected of distributing these items to other people under the legal consumption age.

False Representation of Identity to Law Enforcement

If an officer asks for your ID, you are required by law to present a valid form of identification. What happens if you get caught with a fake id? If you choose to present a false ID, you will be charged with a third-degree misdemeanor. That can carry six months to a year in jail and up to a $2500 fine for the first offense.
